US Bill Proposes 21st-Century Privateers to Combat Cybercrime

A new bill called the Scam Farms Marque and Reprisal Authorization Act of 2025, introduced by Rep. David Schweikert, would allow the U.S. President to issue letters of marque to private actors—essentially state-sanctioned agents or “neo-privateers”—to go after cybercriminals. The powers granted would include seizing property, detaining, or “punishing” individuals involved in offenses deemed threats. Offenses listed include crypto theft, ransomware, identity theft, pig butchering scams, unauthorized computer access, online password trafficking, and distributing malicious code. The proposal frames such cybercrimes as threats to U.S. economic and national security and revives an 18th-century legal tool. Proponents argue it could significantly raise the stakes for attackers; critics warn of potential overreach, enforcement difficulties, and international law risks.
